Important notice — Binding French version

The Make IT Safe Terms of Use (“ToU”) are issued by Make IT Safe (a French company governed by French law). The French-language version is the only legally binding version. This English page provides a summary for convenience and does not replace the French original.

Summary

The Terms of Use govern access to and use of the Make IT Safe SaaS platform for cyber governance, including:

  • Security policy management
  • Risk mapping and assessment
  • Compliance tracking (NIS 2 / ISO 27001 / DORA / LPM)
  • Audit and action plan management
  • Executive dashboards and reporting

Use of the Service requires a valid subscription under the Terms of Sale (CGV). The ToU are a complementary contractual document binding on each User.

Key obligations

  • Account creation requires accurate, complete and up-to-date information; identifier sharing is strictly forbidden.
  • Multi-Factor Authentication (MFA) is mandatory for all Administrator accounts and recommended for other Users.
  • Users must use a strong password (≥ 12 characters), lock their session, and report any compromise immediately to rssi@makeitsafe.fr.
  • Penetration testing, fuzzing or vulnerability scans require prior written authorization (15 working days notice, 10 working days response).
  • Data is hosted exclusively within the EU. No transfer outside the EU without appropriate legal safeguards (EU Standard Contractual Clauses).
  • All User actions are logged for security, audit and traceability purposes (12 months minimum retention).

AI Act notice

The Service is a decision-support tool with automated analysis features. It does not replace the expertise of a qualified cybersecurity, risk management or compliance professional. Risk scores and recommendations are indicative; their accuracy depends on the quality of input data. Make IT Safe does not warrant the regulatory compliance of decisions taken on the basis of these outputs. Users retain full responsibility for strategic and operational decisions.

Governing law and jurisdiction

  • Governing law: French law
  • Amicable resolution: 30-day mandatory attempt before any litigation
  • Jurisdiction: Tribunal de Commerce de Nantes for private-law clients; the territorially competent Administrative Tribunal for public bodies
